Terms of Use

1. Agreement and eligibility

These Terms of Use are a binding agreement between you and Bebeca Health, operated by Bebeca Iglesias. By creating an account, purchasing a membership, or using the Service, you agree to these Terms, the Privacy Policy, the Consumer Health Data Privacy Notice, and the Cookie Policy.

You must be at least 18 years old and legally able to enter this agreement. If you use the Service for an organization, you represent that you have authority to bind it.

2. Accounts

Provide accurate, current information and keep it updated. You are responsible for activity under your account and for protecting your password and confirmation or reset links. Do not share an account or use another person’s account without permission.

Tell us promptly at contact@bebecahealth.com if you suspect unauthorized access. We may require identity verification before changing account or billing information.

3. Educational wellness service — not medical care

Bebeca Health provides educational movement, mobility, yoga-inspired practices, general wellbeing information, and self-reflection tools. The Service does not provide medical advice, diagnosis, treatment, physical therapy, psychotherapy, emergency services, or a patient-provider relationship. Questionnaire scores are informational and are not diagnostic tests.

Consult a qualified healthcare professional before beginning or changing physical activity, especially if you have pain, injury, a medical condition, are pregnant, recently had surgery, or are unsure whether a practice is appropriate. Work within a comfortable range, follow provided modifications, and stop immediately if you feel pain, dizziness, shortness of breath, numbness, or other concerning symptoms. For an emergency, contact local emergency services.

4. Physical activity and assumption of risk

Movement and exercise involve inherent risks, including strain, falls, aggravation of an existing condition, and other injury. You choose whether and how to participate, control your environment and equipment, and remain responsible for your own safety. To the fullest extent permitted by law, you knowingly accept the ordinary risks of voluntary participation.

An instructor may suggest options but cannot assess every participant’s condition through a screen. Do not rely on an instructor’s ability to observe you as a substitute for your own judgment or professional healthcare advice.

5. Memberships, billing, and cancellation

Available prices, billing intervals, included features, and any trial terms are shown before checkout. Memberships renew automatically on the selected monthly or annual interval until canceled. Stripe processes payment information and may apply its own legally required authentication or fraud checks.

You may manage payment details or schedule cancellation from Account → Billing through Stripe’s secure customer portal. Unless the checkout page or applicable law states otherwise, cancellation takes effect at the end of the paid billing period and prevents the next renewal; it does not retroactively refund the current period. If a payment fails, access may be limited or suspended while billing is resolved.

Contact contact@bebecahealth.com promptly about an incorrect or unrecognized charge. Refunds, credits, or exceptions are considered where stated at purchase or required by applicable law.

6. Recorded classes and digital content

A membership grants a personal, limited, revocable, non-exclusive, non-transferable right to stream eligible content while access remains active. Public classes may be available without a membership. Availability can change as the library is updated.

Do not download, copy, screen-record, rebroadcast, sell, sublicense, scrape, or publicly display classes or other protected content except where a feature expressly permits it or law gives you a non-waivable right.

7. Live classes and reservations

Live-class capacity is limited. A confirmed reservation is personal to the account holder and may be canceled through the Service. Start times, instructors, and class details may change when reasonably necessary; canceled sessions will be communicated through the Service or available account contact details.

Live classes use camera, microphone, and screen-sharing technology. You control whether your camera and microphone are enabled, subject to class-format and instructor permissions. Other participants may see or hear what you transmit. Choose an appropriate environment and do not disclose confidential information. You may not record a live class or another participant without prior written permission and every legally required consent.

To protect the class, an instructor or administrator may mute, remove, or restrict a participant who is disruptive, abusive, unsafe, or violates these Terms.

8. Questionnaires, progress, and information you share

Questionnaires and progress tools are for personal reflection. A result is stored in your account only when you choose to save or submit it. When a feature states that a result will be shared with Bebeca Health, submitting it makes that result available to authorized administrators for review and member support.

You retain ownership of information and original content you submit. You grant Bebeca Health a limited license to host, process, display, and transmit it only as needed to provide, secure, and support the Service and comply with law. Do not submit content you do not have the right to use.

9. Acceptable use

You agree not to:

• Break the law, violate another person’s rights, impersonate someone, or provide fraudulent information.
• Harass, threaten, exploit, discriminate against, or endanger instructors, participants, staff, or other users.
• Probe security, bypass membership or meeting controls, share protected access tokens, or interfere with the Service.
• Upload malware, automated scraping tools, unlawful content, or material that infringes intellectual-property or privacy rights.
• Use the Service to provide competing commercial classes, redistribute content, train automated systems on protected content, or resell access without written permission.

10. Intellectual property

The Service, brand, class recordings, written materials, illustrations, design, software, and original teaching materials are owned by Bebeca Health or its licensors and protected by intellectual-property laws. These Terms do not transfer ownership. Names or materials attributed to third parties remain the property of their respective owners.

Feedback may be used to improve the Service without restriction or compensation, but we will not identify you publicly without permission.

11. Third-party services and links

The Service depends on third-party infrastructure and may link to independent websites, products, or resources. Their terms and privacy practices apply to their services. Bebeca Health is not responsible for third-party content, availability, or transactions outside our control, although we select providers intended to support reliable operation.

12. Suspension and termination

You may stop using the Service at any time and may request account deletion, subject to outstanding billing and lawful retention. We may suspend or terminate access for material or repeated violations, fraud, security risk, nonpayment, legal requirements, or conduct that threatens participants or the Service. Where appropriate, we will provide notice and a reasonable opportunity to resolve the issue.

Provisions that by their nature should continue after termination—including payment obligations, intellectual property, disclaimers, limits of liability, and dispute provisions—will survive.

13. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We do not promise that every class or feature will be uninterrupted, error-free, suitable for every person, or produce a particular physical, health, or wellness outcome. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

14. Limitation of liability

To the fullest extent permitted by law, Bebeca Health and its instructors, personnel, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or opportunities arising from the Service. Our total liability for claims relating to the Service will not exceed the greater of the amount you paid to Bebeca Health during the 12 months before the event giving rise to the claim or US$100.

These limitations do not apply to liability that cannot be limited under applicable law, and they do not reduce any mandatory consumer protection.

15. Disputes and applicable law

Before filing a formal claim, please contact contact@bebecahealth.com so we can try to resolve the concern informally. These Terms are governed by applicable United States law and the law of the jurisdiction with lawful authority over Bebeca Health, without overriding mandatory consumer rights where you live. A dispute may be brought in a court that has lawful jurisdiction over the parties and the claim.

16. Changes and general terms

We may update these Terms as the Service or law changes. The current version and effective date appear at the top. If a material change affects account use, payments, privacy, or important rights, we will provide notice and require signed-in users to accept the new version before continuing to use account features.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will continue. A delay in enforcing a term is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a lawful business reorganization. These Terms and the policies they incorporate are the entire agreement about the Service unless separate written terms expressly apply.
